Legal Access for First-Generation Wealth Builders

Legal protection has historically been a tool of the privileged. Access to an attorney, a reviewed contract, or a properly drafted will has too often been gatekept by cost, in ways that have disproportionately landed on Black communities, women, faith communities, and working families building something for the first time in their family's history.

That gap shows up in the numbers, and it shows up generationally. Research on estate planning consistently finds that a significant majority of Black Americans do not have a will in place, a notably higher share than the general population. The consequence isn't abstract. Without a will, state intestate succession law decides who inherits, not the family. Property held informally across generations, often called heirs' property, becomes especially vulnerable to forced sales and to buyers who specifically target families in probate, knowing grief makes people more likely to accept far less than a property is worth.

Here's the reframe that matters: this is not a knowledge gap, and it is not a character gap. It is an access gap, built over decades by who could afford an attorney on retainer and who could not.

Closing that gap doesn't require wealth. It requires access, and access is something that can be made affordable and ongoing rather than something you only reach for in crisis, when it's most expensive and least available.
